Ce d\u00e9lai doit \u00eatre raisonnable\u00a0;<\/li><li>et que\u00a0l\u2019absence de r\u00e9ponse \u00e0 l\u2019issue de ce d\u00e9lai de r\u00e9flexion \u00e9quivaut \u00e0 un refus de cette proposition.<\/li><\/ul><p>Il r\u00e9sulte de ces dispositions que les propositions de CDI qui interviennent apr\u00e8s l\u2019\u00e9ch\u00e9ance du terme du contrat ne sont pas concern\u00e9es par ces nouvelles obligations.<\/p><h3><span style=\"color: #008080;\"><strong>Propositions de CDI devant \u00eatre d\u00e9clar\u00e9es \u00e0 France Travail<\/strong><\/span><\/h3><p>En cas de refus expr\u00e8s ou tacite du salari\u00e9, l\u2019employeur ou, le cas \u00e9ch\u00e9ant, l\u2019entreprise utilisatrice\u00a0:<\/p><ul><li>dispose d\u2019un d\u00e9lai d\u2019un mois pour en informer France Travail ;<\/li><li>proc\u00e8de \u00e0 cette information par voie d\u00e9mat\u00e9rialis\u00e9e sur une plateforme d\u00e9di\u00e9e (<a href=\"https:\/\/www.demarches-simplifiees.fr\/commencer\/refus-de-cdi-informer-francetravail\" target=\"_blank\" rel=\"noopener\">https:\/\/www.demarches-simplifiees.fr\/commencer\/refus-de-cdi-informer-francetravail<\/a>), consultable depuis le site Internet de France Travail.<\/li><\/ul><p>L\u2019employeur doit joindre \u00e0 cette information\u00a0:<\/p><p>\u21d2\u00a0Un\u00a0descriptif de l\u2019emploi propos\u00e9\u00a0;<\/p><p>\u21d2 Des \u00e9l\u00e9ments permettant de justifier dans quelle mesure : Pour les salari\u00e9s en CDD\u00a0: l\u2019emploi propos\u00e9 est identique ou similaire \u00e0 celui occup\u00e9, la r\u00e9mun\u00e9ration propos\u00e9e est au moins \u00e9quivalente, la dur\u00e9e de travail propos\u00e9e est \u00e9quivalente, la classification de l\u2019emploi propos\u00e9 et le lieu de travail sont identiques ;<\/p><p>Pour les salari\u00e9s en contrat de mission\u00a0: l\u2019emploi propos\u00e9 est identique ou similaire \u00e0 celui de la mission effectu\u00e9e, le lieu de travail est identique ;<\/p><p>\u21d2\u00a0La mention du d\u00e9lai laiss\u00e9 au salari\u00e9 pour se prononcer sur la proposition de CDI ;<\/p><p>\u21d2\u00a0La mention de la date de refus expr\u00e8s du salari\u00e9, ou en cas d\u2019absence de r\u00e9ponse, de la date d\u2019expiration du d\u00e9lai de r\u00e9flexion, au terme duquel le refus du salari\u00e9 est r\u00e9put\u00e9 acquis.<\/p><p>Si France Travail estime que les informations ainsi fournies sont incompl\u00e8tes\u00a0:<\/p><ul><li>Il adresse une\u00a0demande d\u2019\u00e9l\u00e9ments compl\u00e9mentaires\u00a0\u00e0 l\u2019employeur.<\/li><li>Celui-ci, ou l\u2019entreprise utilisatrice, dispose d\u2019un d\u00e9lai de\u00a015 jours,\u00a0\u00e0 compter de la r\u00e9ception de la demande, pour y apporter les compl\u00e9ments d\u2019information demand\u00e9s.<\/li><\/ul><h3><span style=\"color: #008080;\"><strong>Privation des droits \u00e0 l\u2019assurance ch\u00f4mage du salari\u00e9 concern\u00e9<\/strong><\/span><\/h3><p>Apr\u00e8s r\u00e9ception de ces informations compl\u00e8tes, France Travail informe le salari\u00e9\u00a0:<\/p><ul><li>que le refus de CDI a \u00e9t\u00e9 signal\u00e9 par son ancien employeur ;<\/li><li>ainsi que des cons\u00e9quences de ce refus sur l\u2019ouverture de ses droits \u00e0 l\u2019allocation d\u2019aide au retour \u00e0 l\u2019emploi (ARE).<\/li><\/ul><p>Pour m\u00e9moire, conform\u00e9ment aux dispositions de la loi du 21 d\u00e9cembre 2022, s\u2019il est constat\u00e9 qu\u2019un demandeur d\u2019emploi a refus\u00e9 \u00e0 deux reprises, au cours des douze mois pr\u00e9c\u00e9dents, une proposition de CDI remplissant les conditions ci-dessus d\u00e9finies et conforme au projet personnalis\u00e9 d\u2019acc\u00e8s \u00e0 l\u2019emploi (PPAE) \u00e0 l\u2019issue d\u2019un CDD ou d\u2019un contrat d\u2019int\u00e9rim, le b\u00e9n\u00e9fice de l\u2019allocation d\u2019assurance ch\u00f4mage ne peut pas lui \u00eatre ouvert sauf s\u2019il a \u00e9t\u00e9 employ\u00e9 dans le cadre d\u2019un CDI au cours de la m\u00eame p\u00e9riode d\u2019un an.<\/p><p>Les textes ne pr\u00e9cisent pas le point de d\u00e9part du d\u00e9lai de 12 mois, de sorte qu\u2019on ne sait pas pr\u00e9cis\u00e9ment, \u00e0 ce jour, si celui-ci s\u2019ouvre \u00e0 compter de la r\u00e9ception par le salari\u00e9 de la proposition de CDI ou de la date du premier refus de celui-ci.<\/p><p>Il est pr\u00e9cis\u00e9 que cette sanction ne trouve \u00e0 s\u2019appliquer que\u00a0:<\/p><ul><li style=\"list-style-type: none;\"><ul><li>lorsque la proposition adress\u00e9e au demandeur d\u2019emploi est conforme aux crit\u00e8res fix\u00e9s par le projet personnalis\u00e9 d\u2019acc\u00e8s \u00e0 l\u2019emploi (PPAE) ;<\/li><li>et lorsque ce dernier a \u00e9t\u00e9 \u00e9labor\u00e9 avant la date du dernier refus du salari\u00e9 pris en compte.<\/li><\/ul><\/li><\/ul><p>En conclusion, il convient de noter que les textes instituant l\u2019obligation pour l\u2019employeur de d\u00e9clarer les refus de CDI \u00e0 l\u2019issue d\u2019un CDD ou d\u2019un contrat de travail temporaire ne pr\u00e9voient aucune proc\u00e9dure de contr\u00f4le de l\u2019application de ces dispositions par France Travail, ni aucune sanction sp\u00e9cifique pour les entreprises qui n\u2019auraient pas proc\u00e9d\u00e9 \u00e0 ces d\u00e9clarations.<\/p><p><strong>\u00a0<\/strong><\/p><p>\u00a0<\/p><p>\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>A
